Blooming Prairie man arrested after allegedly assaulting cops

The passenger in a car stopped by Blooming Prairie police is facing criminal charges after allegedly fighting with officers, spitting at them and trying to bite one of them.
David DeLuna, 44, made his first appearance Monday in Steele County District Court, where he’s charged with two felony counts of fourth-degree assault of a peace officer; two gross misdemeanor counts of fourth-degree assault of a peace officer; and one count of obstructing the legal process, also a gross misdemeanor.
The charges stem from an incident that began about 11:15 p.m. Saturday, when a BP police officer saw a car run a stop sign. When the vehicle stopped, both the driver and passenger – later identified as DeLuna – got out.
According to the criminal complaint, DeLuna had an open bottle of beer, immediately started yelling profanities at the officer, then began to walk away.
When the officer told him he was being detained for the open bottle, DeLuna said he wasn’t driving, and didn’t need to stay.
The officer saw “several signs” of intoxication, the report said; DeLuna continued screaming and swearing and refused to walk with the officer to the squad car. Another officer arrived, and DeLuna reportedly struggled with both of them, “rolling around in the snow … and moving constantly to avoid being handcuffed.”
He was handcuffed in front of his body, then laid on his back and “lunged” at one of the officers to bite him, the complaint said. DeLuna allegedly kicked the officer multiple times, tried to elbow both of them, then started spitting at them.
Steele County deputies arrived by then, and DeLuna reportedly spit at them; one of the deputies eventually put a spit hood on DeLuna for transport to jail.
He remains in custody in lieu of $5,000 conditional bond, and is due back in court Feb. 7.
